Compliance is required if you operate any of the following types of commercial vehicles:

1) Has a gross combination weight rating of 26001 or more pounds inclusive of a towed unit with a gross vehicle weight rating of more than 10,000 pounds

2) Has a gross vehicle weight rating of 26001 pounds or more

3) Is designed to transport 16 or more passengers including the driver

4) Is of any size and is used in the transportation of hazardous materials which requires that the motor vehicle to be placarded

Intrastate operations may be exempted depending upon statutory rule, check with your state department of transportation before considering your operations exempt from the Drug & Alcohol testing regulations.

Owner operators and employers alike must be in compliance with the testing and record keeping requirements.
